1. Introduction

Welcome to Wagerfy. These Terms of Service ("Terms") govern your access to and use of the Wagerfy platform, including our mobile application (available on iOS and as an Android PWA) and website at wagerfy.co (collectively, the "Platform").

Wagerfy is operated by Wagerfy, registered in the Netherlands (KVK: 97387606), with its registered address at 1102, Amsterdam, Netherlands.

By creating an account or using the Platform, you agree to be bound by these Terms and our [Privacy Policy]. If you do not agree, do not use the Platform.

2. Eligibility

2.1 Age Requirement

You must be at least 18 years old to register and use Wagerfy. By creating an account, you confirm that you are 18 or older. We may request proof of age at any time and suspend your account pending verification.

2.2 Legal Compliance

You are solely responsible for ensuring that your use of Wagerfy complies with the laws and regulations applicable in your jurisdiction. Real-money skill-based wagering may be restricted or prohibited in certain regions. By using the Platform, you confirm that doing so is legal where you are located.

2.3 Prohibited Jurisdictions

Without limiting the above, residents of the following jurisdictions may not use the real-money wagering features of the Platform: any jurisdiction where skill-based wagering or real-money gaming competitions are explicitly prohibited by law. It is your responsibility to determine whether your jurisdiction falls into this category. We reserve the right to restrict access by location at any time.

2.4 One Account Per Person

You may only hold one Wagerfy account. Creating multiple accounts is strictly prohibited and will result in immediate termination of all associated accounts and forfeiture of any balance.

3. Account Registration

3.1 Accurate Information

You must provide accurate, complete, and up-to-date information during registration, including your full name, email address, and date of birth. You agree to update this information promptly if it changes.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately at hello@wagerfy.co if you suspect any unauthorised access to your account. Wagerfy is not liable for any loss resulting from unauthorised use of your account due to your failure to keep credentials secure.

3.3 Account Sharing

You may not share your account with or transfer your account to any other person.

3.4 Identity Verification (KYC)

We may require you to verify your identity before processing withdrawals or if we have reason to believe your account poses a fraud or compliance risk. This may include submitting a government-issued ID, proof of address, or other documents. Failure to complete verification may result in suspension of withdrawal access or account termination.

4. The Wagerfy Platform — How It Works

4.1 Skill-Based 1v1 Wagering

Wagerfy enables users to compete in skill-based 1v1 matches across supported games (currently: EA Sports FC, Call of Duty, and Rocket League) and wager real money on the outcome. Outcomes are determined by in-game performance, not chance.

4.2 Match Creation and Acceptance

A user (the "host") creates a match and specifies the wager amount and game settings. Another user (the "challenger") accepts the match. By accepting a match, both parties agree to the stated wager amount and game settings.

4.3 Funds Hold

When a match is accepted, the wager amount is deducted from both users' Wagerfy wallet balances and held in escrow until the match result is confirmed.

4.4 Payouts

Upon match completion and result confirmation, the winner receives the combined wager amount, less any applicable platform fee. Payouts are credited to the winner's Wagerfy wallet.

4.5 Platform Fee

Wagerfy charges a platform fee on each match. The applicable fee rate is displayed before a match is accepted. Users who registered during our founding period and were granted a 0% lifetime fee will have that rate applied to matches they win as the host, as specified at the time of their registration.

4.6 Promotional Credits

Wagerfy may, at its discretion, offer promotional credits to new or existing users. Where offered, promotional credits are subject to any conditions stated at the time of the offer. Unless otherwise stated, promotional credits are non-withdrawable, may only be used to enter matches, and expire after 30 days. Any winnings generated from promotional credits are withdrawable subject to these Terms. Wagerfy reserves the right to modify or withdraw any promotional offer at any time.

5. Deposits, Withdrawals, and Payments

5.1 Payment Processor

All deposits and withdrawals on Wagerfy are processed via PayPal. By making a deposit or requesting a withdrawal, you agree to PayPal's terms of service. Wagerfy does not store your payment credentials.

5.2 Deposits

Deposits are credited to your Wagerfy wallet upon confirmation from PayPal. Minimum deposit amounts may apply and will be displayed at the time of deposit.

5.3 Withdrawals

You may request a withdrawal of your available wallet balance to your verified PayPal account at any time, subject to:

  • Completion of any required identity verification (KYC)

  • Minimum withdrawal amounts as displayed on the Platform

  • Withdrawal processing times (typically 1–5 business days, subject to PayPal processing)

5.4 Non-Refundable Wagers

Once a match has been accepted and funds placed into escrow, wager amounts are non-refundable except in the event of a technical error confirmed by Wagerfy. Disputes about match outcomes must be raised within 24 hours of the match result being recorded.

5.5 Dormant Accounts

If your account has been inactive (no login or transaction) for 12 consecutive months and carries a positive wallet balance, we will notify you by email. If no response or activity is recorded within 30 days of that notice, your account may be classified as dormant. Dormant account balances may be subject to an inactivity fee or forfeiture in accordance with applicable law. We will always attempt to return funds before taking any such action.

6. Fair Play and Prohibited Conduct

6.1 Fair Play Requirement

All matches must be played fairly and in good faith. The following are strictly prohibited:

  • Cheating, modding, or exploiting game glitches or bugs

  • Using unauthorised third-party software or hardware to gain an advantage

  • Collusion with your opponent to manipulate match outcomes

  • Intentionally losing matches (match fixing)

  • Using a substitute player or allowing another person to play on your behalf

  • Playing on incorrect game settings, modes, or platforms contrary to the match agreement

6.2 Reporting

If you believe your opponent has violated fair play rules, you may submit a report through the Platform within 24 hours of the match result. Wagerfy will investigate reports at its sole discretion.

6.3 Consequences

Violations of fair play rules may result in:

  • Match result reversal and/or escrow funds returned

  • Temporary suspension

  • Permanent account termination and forfeiture of wallet balance

  • Reporting to relevant authorities where applicable

7. User Conduct

You agree not to:

  • Harass, threaten, or abuse other users

  • Use hate speech or discriminatory language

  • Impersonate any person or entity

  • Attempt to gain unauthorised access to the Platform, other accounts, or our systems

  • Use automated tools, bots, or scripts to interact with the Platform

  • Post or transmit any harmful, offensive, or unlawful content

  • Engage in money laundering, fraud, or any other illegal financial activity through the Platform

8. Responsible Gaming

Wagerfy is committed to promoting responsible gaming.

8.1 Self-Exclusion

You may request a temporary suspension or permanent closure of your account at any time by contacting us at hello@wagerfy.co. We will process self-exclusion requests promptly.

Where available, you may set deposit limits on your account. Contact us to request this feature.

9. Intellectual Property

All content on the Wagerfy Platform — including but not limited to logos, graphics, software, interface design, and text — is owned by or licensed to Wagerfy and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any Wagerfy content without our prior written consent.

Wagerfy is not affiliated with, endorsed by, or in partnership with EA Sports, Activision, Psyonix, or any other game publisher. All game names and trademarks belong to their respective owners.

10. Termination and Suspension

10.1 By Wagerfy

We reserve the right to suspend or permanently terminate your account, with or without notice, if you:

  • Breach any provision of these Terms

  • Engage in fraudulent, abusive, or illegal activity

  • Fail to complete required identity verification

  • Are found to be under 18 years old

Upon termination for cause, any wallet balance may be forfeited where permitted by law. Upon termination without cause, any available balance will be returned to you via PayPal.

10.2 By You

You may close your account at any time by contacting hello@wagerfy.co. Any available wallet balance will be returned to your verified PayPal account following identity verification where required.

11. Disclaimers and Limitation of Liability

11.1 Platform Availability

Wagerfy is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation of the Platform. We reserve the right to suspend the Platform for maintenance or upgrades at any time.

11.2 No Guarantee of Winnings

Wagerfy does not guarantee any winnings. All match outcomes depend entirely on user skill and performance.

11.3 Limitation of Liability

To the fullest extent permitted by applicable law, Wagerfy shall not be liable for:

  • Loss of winnings or expected profits

  • Indirect, incidental, or consequential losses

  • Technical errors, outages, or delays beyond our reasonable control

  • Actions or conduct of other users on the Platform

Our total aggregate liability to you for any claim arising from your use of the Platform shall not exceed the total amount deposited by you in the 3 months preceding the claim.

11.4 Force Majeure

Wagerfy is not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to internet outages, platform provider failures, acts of government, or natural disasters.

12. Dispute Resolution

12.1 Contact Us First

If you have a dispute with Wagerfy, please contact us first at hello@wagerfy.co. We will make reasonable efforts to resolve disputes informally within 14 days.

12.2 Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands.

12.3 Jurisdiction

Any disputes that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the competent courts of Amsterdam, Netherlands.

12.4 Consumer Rights

Nothing in these Terms limits your statutory rights as a consumer under Dutch or EU law, including your rights under the European Online Dispute Resolution platform, accessible at https://ec.europa.eu/consumers/odr.

13. Anti-Money Laundering (AML)

Wagerfy is committed to preventing money laundering and financial crime. We may:

  • Monitor transactions for suspicious activity

  • Request documentation to verify the source of funds

  • Report suspicious activity to relevant authorities as required by law

  • Suspend or terminate accounts where AML concerns are identified

By using the Platform, you confirm that all funds deposited are from legitimate sources.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

  • Update the "Last Updated" date at the top of this page

  • Notify you by email or in-app notification

Continued use of the Platform after changes take effect constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the Platform and may request account closure.
